Terms of Service

Agreement

By creating an account or using SwingBy you agree to these Terms of Service. If you do not agree, do not use the service.

The service

SwingBy is a tradie activation platform that lets tradies share their availability with nearby customers and receive job requests from local homeowners. The platform is operated by SwingBy Ltd.

Eligibility

You must be at least 18 years of age to use this service. By registering, you confirm that you meet this requirement.

Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@www.swingby.co.nz if you suspect unauthorised access.

Acceptable use

You agree not to use the service to:

• Post illegal, harmful, abusive, or offensive content.
• Impersonate another person or entity.
• Attempt to access, modify, or delete another user’s data.
• Use automated scripts or bots to interact with the platform.
• Engage in any activity that disrupts or interferes with the service.

Wallet credits

Wallet credits loaded on SwingBy are non-refundable and non-transferable. Credits are denominated in NZD and can only be used for platform interactions (RSVPs, join requests, provider applications). Credits cannot be withdrawn as cash. The minimum top-up is NZ$5.00.

The current interaction fee is NZ$0.25 per action. We reserve the right to change interaction fees with reasonable notice.

User content

You retain ownership of content you post (messages, event details, availability information). By posting content on the platform you grant us a limited licence to store and display that content to the users you share it with, for the purpose of providing the service.

Service availability

We strive to keep SwingBy available and reliable but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time.

Termination

We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or cause harm to other users. You may close your account at any time by contacting us.

Limitation of liability

To the extent permitted by New Zealand law, SwingBy is provided “as is” without warranty of any kind. We are not liable for indirect, incidental, special, or consequential damages arising from your use of the service.

Governing law

These terms are governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the courts of New Zealand.

Changes to these terms

We may update these terms from time to time. Continued use of the service after changes are posted constitutes your acceptance of the updated terms. Material changes will be communicated via email to your registered address.
